His wife and young son, who holds US citizenship, have reportedly been prevented from leaving China since his detention in 2024.

Rights groups have raised concerns about his health in custody, while his family continues to seek his release.

The conviction has become a prominent example in a wider debate over how China’s legal system treats political satire and expression that conflicts with the Communist Party’s preferred historical narrative.

Three-year sentence over old artworks

Gao Zhen belongs to the internationally recognised artistic duo known as the Gao Brothers, whose work has examined Chinese history, political power and social change.

Alongside his brother, Gao Qiang, he produced provocative sculptures of Mao, the founding leader of the People’s Republic of China.

Among the works cited in the case was Mao’s Guilt, a sculpture depicting Mao kneeling in apparent remorse. Other pieces from the brothers’ Miss Mao series portrayed the former leader in deliberately grotesque and irreverent forms.

Their work challenged the reverential imagery surrounding Mao, whose rule included the Cultural Revolution of 1966–1976, a period of political persecution and widespread social upheaval.

Chinese authorities prosecuted Gao for allegedly infringing upon the reputation and honour of national heroes and martyrs.

The Sanhe court handed him the maximum three-year prison term available under the relevant offence, according to Amnesty International and reporting by the Associated Press.

Gao was arrested in August 2024 while visiting China with his family. He had moved to the United States in 2022 and held US permanent residency. Despite having made previous visits to China, he remained in custody after his arrest.

A law introduced years later

The timeline of the prosecution has become central to criticism of the verdict.

Gao’s disputed artworks were created between 2005 and 2009.

China enacted its Law on the Protection of Heroes and Martyrs in 2018, while a subsequent amendment to the Criminal Law introduced a specific criminal offence concerning the defamation of heroes and martyrs.

The provision allows imprisonment of up to three years in serious cases.

Article 299a of the Criminal Law provides for punishment where a person insults or slanders a hero or martyr, thereby harming social and public interests, and the circumstances are serious.

The provision forms the legal basis cited in reporting on Gao’s conviction.

The gap between the creation of the artworks and the introduction of the relevant criminal provision has prompted questions about the application of the law to earlier conduct.

Amnesty International said the case involved the retrospective use of legislation against artistic work created years before the offence was introduced.

In an update published on 2 October, the organisation reiterated its concerns about Gao’s conviction, his reported health problems and the continuing restrictions on his family.

Gao has decided to appeal the conviction and sentence. Amnesty said the case had moved into the appeal process, with the conviction remaining in place at the time of its latest update.

Closed-door proceedings raise questions

Gao’s trial took place on 30 March 2026 at the Sanhe City People’s Court.

The one-day hearing was held behind closed doors, and no verdict was announced immediately afterwards, according to Reuters reporting carried by The Guardian.

Gao’s wife, Zhao Yaliang, said she was barred from entering the courtroom. European Union diplomats also attempted to attend the proceedings but were denied entry, according to the EU’s mission to China.

When the court announced Gao’s sentence on 25 August, US diplomats and representatives from several other diplomatic missions again attempted to observe the hearing.

The US State Department told Reuters that Chinese court officials refused them entry.

Washington said it had “significant concerns” about a conviction linked to actions that allegedly occurred years before the law under which Gao was sentenced came into force.

The department also reaffirmed its support for freedom of expression, including artistic expression.

The restricted access to the proceedings has added to concerns about transparency and scrutiny in a case involving a politically sensitive subject.

The available reporting does not provide a complete account of the court’s reasoning, making independent assessment of the judgment more difficult.

Family caught in the case

The restrictions reportedly imposed on Gao’s family have widened the controversy.

Zhao and the couple’s young son, a US citizen, have been unable to leave China since Gao’s detention, according to Amnesty International and media reports. The family has not

been accused of a crime in connection with the artist’s case.

Zhao has described the separation as deeply distressing for their son, who has been unable to see his father since 2024. Reports have also indicated that communication between Gao and his family was severely restricted.

Amnesty International said in October that Gao’s wife and son remained subject to a de facto exit ban.

The organisation called for the restrictions to end, arguing that the family should not face travel restrictions when they have not been accused of wrongdoing.

The circumstances have renewed scrutiny of the use of exit restrictions in politically sensitive cases.

Although Chinese authorities can impose travel restrictions under domestic law in certain circumstances, the reported restrictions on Gao’s family have prompted questions about the consequences for relatives who are not themselves facing criminal charges.

Health concerns in detention

Gao’s prolonged detention has also raised concerns about his physical condition.

Amnesty International’s October update said reports of his apparent poor health had heightened concerns about his treatment in custody.

Earlier accounts cited several medical conditions, including lumbar spine disease and fluid accumulation in his knees. Reports also said he had collapsed on several occasions during detention.

These reports have not been independently established through public medical records, but rights groups have called attention to the risks posed by prolonged detention and limited communication with family.

Gao’s age and reported health problems have added urgency to calls for a review of his case. His conviction, meanwhile, remains subject to appeal.

Political loyalty and the limits of criticism

The prosecution comes amid a broader consolidation of political authority under Xi Jinping.

In 2018, China amended its constitution to remove the two-term limit on the presidency, allowing Xi to remain in office beyond the previous norm of two five-year terms.

Under Xi, the Communist Party has continued to stress political loyalty, ideological discipline and the protection of its official historical narrative. The authorities have also maintained extensive controls over online expression, public

commemorations and politically sensitive discussions.

The legal protection afforded to national heroes and martyrs reflects the state’s emphasis on safeguarding the reputation of figures associated with the country’s revolutionary history.

However, the application of such provisions to satirical artwork raises a difficult question about the boundary between protecting public interests and criminalising criticism.

The authorities have not publicly established that Gao’s case represents a general policy of prosecuting every artist who depicts Mao critically.

Nevertheless, his sentence demonstrates that artwork created years earlier can become the basis of a criminal prosecution when officials determine that it violates the law.

For artists, writers and commentators, the case carries implications beyond the punishment imposed on one individual. It illustrates the legal risks that can arise when creative expression challenges politically protected figures or narratives.

A wider warning for independent expression

Gao’s conviction has drawn attention because of the subject of his art, the time elapsed since its creation and the restrictions reportedly imposed on his family.

The maximum three-year sentence, the closed-door trial and the questions surrounding the retrospective application of the law have placed the case under international scrutiny.

The appeal will determine the next stage of Gao’s legal proceedings. Until then, the conviction remains a significant example of the way Chinese authorities have applied the law protecting national heroes and martyrs to political satire.

The case also leaves unresolved questions about how far artistic criticism can go when it addresses figures central to the Communist Party’s account of national history.

For Gao, sculptures created between 2005 and 2009 have become the basis of a prison sentence imposed in 2026. For other independent artists, the case has sharpened the uncertainty surrounding the boundaries of permissible expression in China.

(The author, Mg Phyu Phway, is a researcher who studies and monitors Asia-Pacific affairs.
